MAQASHID SYARIAH DALAM PERSPEKTIF IBNU ASYUR

Abstract

Maqasid al Sharia can be a sharia maqasid al'ammah, which covers all aspects of sharia and maqasid sharia al khasah which is devoted to one chapter of the existing sharia chapters, such as maqasid al Sharia in the field of economics, family law and others, or maqasid Syariah al juz'iyyah which includes every law of shara' such as prayer obligations, forbidden adultery, and so on. In this paper, the discussion will focus on the theory of maqashid sharia according to Ibn Ashur. With the hope of being able to know the characteristics and uniqueness of the theory. This research is a study that uses a qualitative descriptive approach using the literature study method, namely by searching and studying literature that is related to the problem that is the object of this research study. Ibn Ashur on maqashid al shar'iyyah, he was a philosophical method of law formation. With his method of determining the maqashid of Sharia, it is revealed that the basic idea of Ibn Ashur's legal determination is based on philosophy. From his theory of shari'ah law induction it appears that the majority of these theories refer to two things: first, taqshid al nushus wa al ahkam (seeking the purpose of texts and laws), secondly seeking the postulate of such laws
